Welcome to Inkspell!
By creating an account and using the Inkspell app (89 287 085 792) ("App"), you agree to be bound by these Terms and Conditions ("Terms"). Please read them carefully. If you do not agree with any part of these Terms, you should not use the App.
By signing up for or using the Service, you agree to the Terms on behalf of yourself and all members of your household and others who use the Service under your Inkspell account.
1. Your Account
To access Inkspell's services, users must create an account. Account creation is free and you are required to provide a valid email address and create a password.
By providing your email, you consent to receive communications from Inkspell related to your account and our services.
You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
2. Access to Free Content
Users with an active account on Inkspell have access to a selection of content provided at no additional charge. This content may include, but is not limited to, AI-generated stories, staff-created stories, public domain books, and licensed content.
Inkspell reserves the right to add, modify, or remove content made available for free at any time without notice. This may include rotating the selection of free content based on licensing agreements, copyright considerations, or our editorial discretion.
3. Create Your Own Story
Inkspell offers a feature called "Create Your Own Story", allowing users to input a prompt for our AI to create and narrate stories.
Your initial account registration includes three (3) credits that can be redeemed to access this feature to create stories for free. These credits will expire 30 days after your account creation date. Additional credits for the "Create Your Own Story" feature are available for purchase and will be accessible to you indefinitely once bought.
Inkspell offers three distinct story types through the "Create Your Own Story" feature, each varying in length and thematic depth to suit different user preferences:
Stories created through the "Create Your Own Story" feature will be available in your library for you to access indefinitely except as otherwise set out in these Terms.
4. Credits
Credits can be purchased by users through Inkspell to access and create personalised stories using the "Create Your Own Story" feature. Credits are sold individually and in bundles, and prices may vary based on the current offers and promotions. Users can view and manage their credit balance and history through their account settings on Inkspell.
Credits are deducted from the user's account balance at the time of transaction for the selected feature or content. Unused credits are valid for an unlimited time, unless specified in the promotional terms and conditions of the purchase.
All credit purchases are final. Credits may only be redeemed on the App, have no cash value, are non-transferable and non-refundable, except as required by applicable law.
Users who subscribe to an Inkspell membership may receive credits as part of their membership benefits. These credits may have different terms of use, including but not limited to, a different expiry period as specified in the membership details.
5. Membership Plans
As part of our Service, we offer membership plans available for weekly, monthly and quarterly periods. Purchasing a membership grants you unlimited access to all pre-made stories and collections for the duration of the membership. Additionally, members receive (3) credits to use per week for the "Create Your Own Story" feature. Credits are renewed every 7 days, from the date of the membership initiating. Credits unused within 7 days will expire.
Members might cancel their membership any time and the cancellation will be effective at the end of the current membership period. Members will be able to continue enjoying their premium access until such time. Membership does not cover content or credits purchased separately. Upon cancellation of an Inkspell membership, access to membership-exclusive content is revoked, but users retain access to previously created or separately purchased content.
6. Purchased Content
Inkspell offers unique stories, books, and collections ("Purchased Content") for sale to users. This Purchased Content is available to users who purchase set stories and collections or sign up for a membership. From time to time, Inkspell may offer promotional discounts on these purchases. All fees and promotional offers will be clearly stated at the point of sale.
Upon completion of purchase, users are granted indefinite access to the Purchased Content. This means that once Purchased Content is bought, it will be available to the user without any additional fees or expiration dates, subject to the terms outlined herein.
All sales of Purchased Content are final. Purchased Content is non-refundable except as required by applicable law or under specific circumstances where the content is faulty, not as described, or where mandatory statutory consumer rights are not met.
Inkspell strives to ensure continuous access to Purchased Content but reserves the right to withdraw or alter this content without liability, should copyright, licensing, or other legal reasons necessitate such action. In such cases, Inkspell will endeavour to provide a suitable replacement or offer a refund at its discretion.
7. Content Creation Policy
Content created through "Create Your Own Story" must comply with our content guidelines [Content Creation Policy], which prohibits sexually explicit material, extreme violence, hate speech, incitement to violence, or any content that violates laws or regulations.
Users are responsible for the content they create and share, ensuring it is appropriate for its audience. 8. Artificial Intelligence Services
Inkspell leverages third-party artificial intelligence technology, including services provided by OpenAI, to generate content and facilitate certain features within the app, such as the "Create Your Own Story" functionality. The use of these third-party AI services is governed by the terms and conditions and privacy policies of the respective providers. Users acknowledge that the voices generated by Inkspell's AI services, including those used in story narration, are synthesised and not performed by real people. The stories created by or available through Inkspell, including characters and scenarios, are fictional and not based on real events or individuals. Any characters introduced by Inkspell as storytellers or associated with the brand in any capacity are purely fictitious and not intended to represent real individuals.
Inkspell provides a platform for creative storytelling, with content generated by AI based on user inputs or created by our staff. Users understand that all stories, including those generated by AI, are works of fiction. Any resemblance to actual persons, living or dead, or actual events is purely coincidental and unintended. By using Inkspell and its AI-powered features, users acknowledge and accept that the AI services are subject to the terms and conditions of third-party providers, such as OpenAI. Users agree that Inkspell is not responsible for the content or outcomes generated by third-party AI technologies and that Inkspell does not endorse or guarantee the accuracy, appropriateness, or quality of any AI-generated content.

Users of Inkspell are expected to engage with the service and its community respectfully, responsibly, and in compliance with all applicable laws. This includes respecting the rights and dignity of others, as well as the intellectual property rights of content creators and Inkspell.

The free content provided through Inkspell is for personal, non-commercial use only. Users may not use this content for any commercial purposes without express written consent from Inkspell or the copyright/trademark owners, where applicable.
Redistribution, public performance, or public display of any content provided for free through Inkspell is prohibited unless explicitly allowed under these terms or with written permission from Inkspell.
11. Intellectual Property
Inkspell respects the intellectual property rights of others and expects its users to do the same. The service, including but not limited to its software, design, text, images, and graphics, is the property of Inkspell or its licensors and is protected by international copyright, trademark, and other intellectual property laws, except as explicitly stated herein.
Inkspell provides access to a variety of content, including, but not limited to, original stories created by our AI or staff, as well as books or retellings derived from Public Domain books and stories. While content from the Public Domain is not subject to copyright protection, Inkspell takes care in curating and presenting such content. Any adaptations, compilations, or retellings of Public Domain material offered by Inkspell are the result of our creative effort and are therefore considered unique intellectual property owned by Inkspell or its licensors.
Users are prohibited from using Inkspell's services to create or distribute content that is illegal, violates the rights of others, or is in violation of Inkspell's content creation policies. This includes, but is not limited to, content that is defamatory, obscene, offensive, or promotes hate speech.
12. Data Collection and Privacy
Inkspell collects only the user's email address and demographic and behavioural data for service optimisation. Payment processing is handled by Stripe Payments, under their terms and conditions. We do not share user data with third parties, and analytical data is not linked to individual users. 13. Inkspell Liability
Inkspell, its officers, directors, employees, or agents will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from your access to or use of the content provided through the service.
The content provided through Inkspell is offered "as is" without warranties of any kind, either express or implied. Inkspell does not guarantee that the content will meet your requirements or that the service will be uninterrupted or error-free.
14. Changes to Terms and Services
Inkspell reserves the right to modify these Terms and its services at any time. Users will be notified of significant changes. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
15. Termination
We may terminate or suspend your account and bar access to the App immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including, without limitation, a breach of these Terms.
Users can terminate their account and request a deletion of their data by emailing support@Inkspell.app. Credits will expire immediately upon the termination of your account unless used prior to termination.
16. Governing Law
These terms and conditions are governed by the laws of the jurisdiction in which Inkspell operates. Any disputes arising under these terms will be resolved in accordance with the laws of that jurisdiction.

- Enchanted Tales: Medium-length stories, up to 20 minutes, filled with magic and wonder, ideal for engaging the imagination and inspiring adventure. Enchanted Tales cost (2) credits.
- Epic Adventures: The longest narratives, extending up to 30 minutes, featuring complex plots and expansive worlds for an immersive storytelling experience. Epic Adventures cost (3) credits.
Stories created through the "Create Your Own Story" feature will be available in your library for you to access indefinitely except as otherwise set out in these Terms.

Content Creation Policy
Inkspell encourages creativity and storytelling through our "Create Your Own Story" feature. However, to maintain a respectful and lawful community, all user-generated content must adhere to the following guidelines.

Inkspell will review reported content and take appropriate action, which may include removal of the content and/or disciplinary action against the offending user. Users might report content on the App ‘Report Issues’ section or by emailing support@Inkspell.app.
By creating content on Inkspell, users grant Inkspell a non-exclusive, royalty-free licence to use, reproduce, adapt, publish, and display the content as part of our service. This licence allows Inkspell to promote and improve our services. Users retain ownership of their original content and are responsible for securing any necessary permissions or licences for any third-party content included in their stories.
Inkspell is a community of storytellers and readers. We ask all users to respect each other's creative expressions and engage positively. Constructive feedback is encouraged, but respect and kindness should guide all interactions.
Users must not create stories that include:
- Sexually Explicit Material: Content that is pornographic or intended to sexually arouse.

Artificial Intelligence Service Agreement
Inkspell provides certain features that are powered by artificial intelligence ("AI"), including but not limited to the "Create Your Own Story" service. These AI Services allow users to generate unique stories based on user-provided prompts. By using the AI Services, you agree to provide appropriate prompts and to not misuse the AI functionality in ways that could lead to the generation of prohibited content as outlined in our Content Creation Policy. The content generated by AI Services, while based on user prompts, is created by proprietary algorithms and as such, the intellectual property rights of such content are owned by Inkspell. Users are granted a non-exclusive, non-transferable licence to use the AI-generated content for personal, non-commercial purposes, unless otherwise specified in a separate agreement. Users are responsible for the prompts they provide and the resulting AI-generated content. Inkspell reserves the right to review and, if necessary, remove any content generated through AI Services that violates our Content Creation Policy or is otherwise deemed inappropriate or unlawful.
While Inkspell strives to ensure that AI-generated content is accurate and appropriate, we cannot guarantee that the outcomes will always meet user expectations or that the AI will not generate content that could be deemed offensive, inaccurate, or inappropriate. Users should exercise judgement and caution when using AI Services.
Inkspell makes no guarantee regarding the availability of AI Services, and these services may be modified, suspended, or discontinued at Inkspell's sole discretion without notice. Users acknowledge that technical issues or other factors may result in service interruptions or errors in AI-generated content, for which Inkspell shall not be liable.
Users are encouraged to provide feedback on AI Services, which may be used by Inkspell to improve the quality and functionality of the AI. Inkspell reserves the right to incorporate such feedback into the service without any obligation to the user.
By using Inkspell's AI Services, users acknowledge and agree to these terms, understanding that their interaction with AI is subject to the limitations and conditions set forth herein. Users agree to indemnify and hold harmless Inkspell from any claims, damages, or losses resulting from their use of AI Services.
